Terms and Conditions for Eskoler Shop

1. Introduction and Scope

Welcome to Eskoler Shop (“Platform”, “we”, “our”, or “us”), operating at shop.eskoler.com. Eskoler Shop is an integrated e-commerce sub-platform of the Eskoler SaaS ecosystem (app.eskoler.com).

By accessing or using Eskoler Shop, whether via web browser or the Eskoler User App, you agree to be bound by these Terms and Conditions (“Terms”). These Terms supplement the core Eskoler SaaS Terms of Service. If you do not agree to these Terms, you must refrain from using the Platform.

2. Account Integration and User Roles

Eskoler Shop operates seamlessly with the Eskoler SaaS platform. Your login credentials for app.eskoler.com serve as your secure authentication for shop.eskoler.com.

  • Access Restrictions: Eskoler Shop is accessible only to registered Admins (School Management), Teachers, and Parents. Student accounts are strictly prohibited from accessing, browsing, or making purchases on Eskoler Shop.
  • User Capabilities: Admins, Teachers, and Parents can browse and purchase products tailored to their academic needs. Users do not digitally curate product lists, create packages, or designate sellers directly within the platform interface.
  • Offline Curation: Schools manually coordinate with vendors outside of the platform to curate specific educational packages or required supply lists.

You are responsible for maintaining the confidentiality of your account credentials across both platforms and ensuring unauthorized users (including students) do not use your account to make purchases.

3. Targeted Suggestions and AI Integrations

To provide a highly relevant and frictionless shopping experience, Eskoler Shop utilizes advanced integrations:

  • Eskoler SaaS Interoperability: We utilize non-sensitive educational data (such as a student’s grade level, enrolled courses, or school affiliation accessed via the Parent’s account) from the Eskoler App to generate Targeted Product Suggestions.
  • Artificial Intelligence (Gemini API) & Third-Party Services: Eskoler utilizes external services, including Google’s Gemini API, to power search functionalities, intelligent product recommendations, and automated user assistance. By using the Platform, you acknowledge that certain queries and interactions may be processed by these third-party AI services. We do not guarantee the absolute accuracy of AI-generated suggestions, and all data processing strictly adheres to our Privacy Policy.

4. Seller Ecosystem, Badges, and Classifications

Eskoler Shop features various third-party vendors. We categorize and badge sellers to help buyers make informed decisions based on the offline coordination between schools and vendors:

  • School’s Trusted Supplier: When a school manually instructs a vendor to create specific educational packages, Eskoler verifies this and awards the vendor a “School’s Trusted Supplier” badge. This helps Parents easily identify the correct, school-approved materials. Eskoler relies on the school’s manual verification for this badge and does not independently guarantee the vendor’s fulfillment.
  • Featured Sellers: Vendors promoted directly by Eskoler based on platform-wide metrics, quality standards, or promotional agreements.
  • General Sellers: Verified independent merchants operating on the platform without specific school-affiliated badges.

5. Payments, UPI, and Cash on Delivery

All prices are listed in Indian Rupees (INR). We offer the following payment methods:

  • Non-Gateway UPI Payments: Eskoler utilizes direct UPI payment plugins rather than traditional payment gateways. In the event of a failed UPI transaction where funds are deducted from your bank but the order is not confirmed, the resolution relies upon the standard processing times of the National Payments Corporation of India (NPCI) and your respective bank. Eskoler is not liable for banking delays.
  • Cash on Delivery (COD): Buyers selecting COD agree to hand over the exact invoiced amount to the delivery agent prior to unboxing the package. We reserve the right to suspend the COD option for any user account demonstrating a history of refusing deliveries.

6. Delivery and Shipping Policy

Eskoler exclusively manages the delivery and logistics for all school orders placed on the Platform. We offer two distinct delivery methods:

While Eskoler manages the logistics, we are not responsible for delays caused by unforeseen circumstances, natural disasters, or the unavailability of the buyer at the time of delivery.

7. Returns, Refunds, and Marketplace Status

  • Intermediary Safe Harbor: Eskoler operates strictly as a technology intermediary under Section 79 of the Information Technology Act, 2000. While we manage the deliveries, we do not manufacture the products or hold inventory.
  • Vendor Responsibility for Returns: All returns, replacements, and refunds are solely managed and processed by the individual Sellers according to their clearly stated shop policies, not by Eskoler.
  • Dispute Facilitation: We provide a communication dashboard within the Eskoler App to facilitate dispute resolution between the Buyer and the Seller.

8. Seller Obligations, Fees, and Tax Compliance

  • Category-Based Commissions: Sellers operating on Eskoler Shop agree to pay a category-based commission on every successful sale. This percentage is dynamically calculated based on the product category.
  • Logistics & COD Commission Settlement: Because Eskoler manages delivery and COD cash collection, seller payouts will be settled after deducting Eskoler’s logistics fees and category-based commissions.
  • Tax Withholding: In compliance with Section 194-O of the Income Tax Act, 1961, Eskoler may collect Tax Deducted at Source (TDS) or Tax Collected at Source (TCS) on platform transactions. Sellers must provide valid GSTIN and PAN details.

9. Prohibited Conduct

Users of Eskoler Shop agree not to:

  • Attempt to bypass, hack, or manipulate the interoperability bridge between the Shop, the Eskoler SaaS, or our integrated APIs.
  • Allow students to access the platform using an Admin, Teacher, or Parent account.
  • Submit fraudulent reviews or misrepresent their affiliation with a school or seller.
  • Use the platform for the sale or purchase of illegal, counterfeit, or prohibited goods.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Eskoler, its parent company, affiliates, and partners shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Eskoler Shop. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid in connection with the disputed transaction.

11. Grievance Redressal Mechanism

In accordance with the Consumer Protection (E-Commerce) Rules, 2020, Eskoler has appointed a Grievance Officer to address user complaints.

12. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Significant changes will be communicated via push announcements on the Eskoler User App or via email. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with the use of Eskoler Shop shall be subject to the exclusive jurisdiction of the competent courts situated in Bikaner, Rajasthan.
